Twitter is refusing to hand over the message history of one of its users to a New York state court despite requests from the government. Occupy Wall Street protester Malcolm Harris is accused of willfully disobeying police instructions not to block traffic during a contentious protest on the Brooklyn Bridge last October, and prosecutors say his tweets reflect as much. But Twitter is resisting the court order on the grounds that, as reflected in their terms and service, customers' tweets are their own personal property and thus protected under the fourth amendment against unlawful search and seizure. The move has been hailed by the ACLU, which in a blog post concerning the matter said, "If Internet users cannot protect their own constitutional rights, the only hope is that Internet companies do so." ACLU Lawsuit Halts NJ Tru-Id Driver's LicenseThe group filed a lawsuit against the state Motor Vehicle Commission, alleging the Tru-ID was being implemented without public notice. ACLU officials, joined by advocates for homeless, immigration and women's groups, said at a news conference Monday that the injunction was sought mainly on claims that the state imposed the system, known as TRU-ID, without publishing details or soliciting public comment as required under state law. "This lawsuit was about process," ACLU New Jersey legal director Ed Barocas said. "It was filed because the state and MVC tried to implement TRU-ID unlawfully, by going around the constitutional mandate." Previously, people could simply state their Social Security numbers to get a license. Under the new standards, they would have to show the card itself or a pay stub or tax documents. They also would have to show two proofs of residence, rather than the one that's required now. ACLU's Lawsuit Temporarily Halts New License StandardsA lawsuit filed by the American Civil Liberties Union of New Jersey has led to a court order that temporarily put the brakes on the state's attempt to implement new federal standards to obtain and renew drivers' licenses. The program, called TRU-ID, which was supposed to go into effect today, was created in response to the federal Real ID Act of 2005. The act seeks to establish a national ID card that will be required to board airplanes and enter federal buildings.
